IMPORTANT NOTICE

THIS AGREEMENT CONTAINS A BINDING ARBITRATION PROVISION AND CLASS ACTION WAIVER. IT AFFECTS YOUR LEGAL RIGHTS AS DETAILED IN THE ARBITRATION AND CLASS ACTION WAIVER SECTION BELOW. PLEASE READ CAREFULLY.

PLEASE NOTE THAT YOUR USE OF AND ACCESS TO THE PLATFORM (DEFINED BELOW) ARE SUBJECT TO THE FOLLOWING TERMS; IF YOU DO NOT AGREE TO ALL OF THE FOLLOWING, YOU MAY NOT USE OR ACCESS THE PLATFORM IN ANY MANNER.

1. Acceptance of Terms

These Terms of Use (“Terms”) are a binding legal agreement between you and askatoz.com (“askatoz.com,” “we,” “us,” or “our”). “User,” “you,” and “your” refer to the individual or entity that uses the websites, applications, and other offerings from askatoz.com (collectively, the “Platform”). “Customer” refers to the person who asks a question on the Platform. “Expert” refers to the person who answers a question on the Platform. Customer and Expert together are “Users.”

Except in your capacity as an Expert or in an application to act as an Expert, which shall be governed by the Expert Agreement, these Terms govern your use of the Platform.

By using or otherwise accessing the Platform or clicking to accept or agree to these Terms, you:

Accept and agree to these Terms;
Consent to the collection, use, disclosure, and handling of information as described in our Privacy Policy;
Agree to comply with all rules, policies, and disclaimers posted on the Platform.

If you use the Platform on behalf of an entity, you represent and warrant that you have the authority to bind that entity.

2. The Platform

The askatoz.com Platform is an online venue for informational and educational purposes that connects Customers with Experts. askatoz.com does not provide professional advice or services and is not in the business of providing or selling information within any Expert’s area of expertise.

Users — not askatoz.com — provide content posted on the Platform (“Posts”), including questions, answers, comments, profiles, and other communications. Experts are independent users and are not employees or agents of askatoz.com.

Experts have sole discretion in selecting questions and determining how to perform services. askatoz.com is not involved in conversations between Users and is not responsible for:

Acts or omissions of Users;
Content in Posts;
An Expert’s failure to complete a transaction.

Certain tools (“Tools”) offered on the Platform may use artificial intelligence or automated technologies. Use of these Tools is optional and subject to these Terms and our Privacy Policy.

You are solely responsible for transactions with Experts, including payment obligations.

Emergency Situations:
Emergency or crisis situations (especially medical or mental health issues) should not be directed to the Platform. Please contact qualified professionals immediately (for example, in the U.S., call 911).

The term “Expert” describes users who answer questions and does not guarantee any particular level of expertise.

Answers provided are for general informational purposes only and are not a substitute for professional advice. No attorney-client, doctor-patient, accountant-client, or other professional relationship is formed through the Platform.

3. Additional Premium Services

You may be offered services outside of the standard question-and-answer Platform (“Additional Premium Services”). askatoz.com only facilitates communication and does not provide the substance of such services.

askatoz.com is not liable for any acts or omissions of Experts related to Additional Premium Services.

Types of Additional Premium Services

Information Only: General informational services that may occur off-platform.
Beyond Information Only: Services that may evolve into a professional relationship off-platform.

Beyond Information Only Services

askatoz.com is not involved in agreements between you and Experts.
No professional-client relationship is formed by askatoz.com.
askatoz.com does not guarantee Expert availability or qualifications.
askatoz.com is not a law firm or referral service.

Information Only Services

Services are for general informational purposes only.
The professional may not be licensed in your jurisdiction.
No professional-client privilege applies.

Remote Desktop Services

If you accept Remote Desktop Services, you grant the Expert access and control over your computer for diagnostic or repair purposes. Any third-party software installed will be licensed to you. Sessions may be recorded for security purposes.

4. Fair Use Policy

Membership subscriptions are intended for personal, non-transferable, and non-resale use only. Excessive use may impair our ability to provide services at reasonable prices.

You may ask verified Experts unlimited questions within eligible categories during your subscription period, subject to this Fair Use Policy. Eligible categories may change at askatoz.com’s sole discretion.

5. Modification of Terms or Platform

Except for Section 18 (Binding Arbitration and Class Action Waiver), askatoz.com reserves the right, at its reasonable and sole discretion, to modify or replace these Terms at any time.

You are responsible for reviewing and becoming familiar with any such modifications. If we determine a revision is material, we will notify you as required by law. Your continued use of the Platform after changes become effective constitutes acceptance of the modified Terms. If you do not accept the changes, you must discontinue use of the Platform.

askatoz.com reserves the right at any time to modify, suspend, discontinue, or terminate, temporarily or permanently, the Platform or associated services (or any part thereof), with or without notice. Except for payments or refunds expressly available under these Terms (or as required by law), askatoz.com shall not be liable for any modification, suspension, or discontinuance of the Platform.

6. Eligibility & Account Creation

Only individuals who are at least 13 years old and capable of forming legally binding contracts under applicable law are permitted to access the Platform. If we learn we have collected personal information from a child under 13, we will delete that information as required by law. If you believe a child under 13 has provided personal information, please contact us at info@askatoz.com.

To prevent fraudulent use of membership programs, Customers who have purchased memberships may be restricted from participating as Experts during their active membership term, including certain household members where applicable.

You must create an account (“Account”) to access certain features of the Platform. You agree to provide accurate, current, and complete information, and to update it as necessary.

You are responsible for safeguarding your password and for all activities under your Account. You must notify askatoz.com immediately of unauthorized use. We are not liable for losses resulting from unauthorized Account use.

Your Account is non-transferable except with written permission from askatoz.com. We may request identity verification as permitted by applicable law.

7. Posts and Communications with Experts

Posts and communications between you and Experts, including phone or virtual communications, are not confidential and may be used by askatoz.com for lawful purposes. They are not protected by attorney-client, doctor-patient, or similar privilege. Communications may be recorded or indexed by search engines.

You retain ownership of your Posts. However, you grant askatoz.com a non-exclusive, irrevocable, perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, display, modify, publish, and create derivative works from your Posts in any media. This license survives termination of your Account or these Terms.

askatoz.com reserves the right (but has no obligation) to remove, edit, or reject Posts at its discretion. You are solely responsible for content you submit and warrant you have the rights to do so.

You may be exposed to content that you consider offensive. askatoz.com does not guarantee the identity of Users and is not responsible for interactions between Users.

8. Prohibitions

You agree not to use the Platform for any unlawful purpose or in violation of these Terms. Prohibited activities include, but are not limited to:

Manipulating ratings or feedback systems;
Creating multiple Accounts;
Using another User’s Account;
Submitting unlawful, defamatory, abusive, obscene, or infringing content;
Violating intellectual property rights;
Uploading viruses or malicious code;
Using automated bots, scrapers, spiders, or AI tools to access or extract Platform content;
Training artificial intelligence systems using Platform content;
Bypassing payment systems or soliciting Users outside the Platform;
Reselling or commercially exploiting Platform content without written consent;
Reverse engineering or attempting to obtain source code;
Violating applicable laws or regulations;
Recruiting Users for off-platform services unrelated to Platform purposes.

Violation of these Terms may result in suspension or termination of your Account. askatoz.com reserves the right to remove content and report unlawful activity to authorities.

9. Notice and Procedure for Making Claims of Copyright Infringement

askatoz.com respects intellectual property rights. We will disable or terminate Accounts of Users found to infringe intellectual property rights.

If you believe that your copyrighted work has been infringed, please contact us at info@askatoz.com with:

A description of the copyrighted work;
The URL or location of the infringing material;
Your contact information;
A statement that you have a good faith belief the use is unauthorized;
A statement that the information provided is accurate and you are authorized to act on behalf of the copyright owner.

10. Fees, Refund and Cancellation Policy

The askatoz.com Platform allows Customers to post questions to Experts and receive responses (“Site Access Benefits”). Customers may be offered one of the following payment models: (1) Membership subscription; (2) Additional Premium Services; or (3) Pay-Per-Question.

Membership & Renewal

Memberships automatically renew (monthly, annually, or as selected at signup) unless cancelled at least 24 hours before the next billing cycle. By subscribing, you authorize recurring charges at the then-current rate. Membership fees are non-refundable except as required by law.

askatoz.com may change Membership pricing or benefits with prior notice. If you do not agree to changes, you must cancel before the next billing cycle.

Cancellation

You may cancel your Membership anytime by:

Using your account cancellation option;
Emailing info@askatoz.com;
Through the App Store (if purchased there).

Cancellation stops future charges. No partial refunds are provided.

Pay-Per-Question

Customers may select a price for a single question. Charges may apply upon posting or upon Expert response. Fees are non-refundable except as expressly permitted.

Additional Premium Services

Additional Premium Services fees are divided between askatoz.com (platform facilitation fee) and the Expert (service fee). Once accepted, your payment method will be charged automatically.

Payment Information

You authorize askatoz.com to charge your provided payment method for all applicable fees, taxes, and optional tips/bonuses. Failure to pay may result in suspension or termination of access.

11. Proprietary Rights and Limited License

All rights, title, and interest in and to the Platform are owned exclusively by askatoz.com and its licensors. All intellectual property including text, graphics, logos, software, and content are protected by applicable laws.

Subject to compliance with these Terms, askatoz.com grants you a non-transferable, non-exclusive, revocable, limited license to access and use the Platform. All rights not expressly granted are reserved.

12. Feedback

If you submit feedback, suggestions, or comments (“Feedback”), you grant askatoz.com a perpetual, worldwide, royalty-free license to use, modify, distribute, and publish such Feedback.

askatoz.com is not obligated to keep Feedback confidential.

13. Third Party Links & Services

The Platform may contain links to third-party websites or services. askatoz.com does not control or endorse such third parties and is not responsible for their content or services.

Users are responsible for evaluating third-party content and services independently.

14. Duration and Termination

These Terms remain effective until terminated by you or askatoz.com.

You may terminate your account by emailing info@askatoz.com. Termination does not relieve you of outstanding payment obligations.

askatoz.com may suspend or terminate accounts at any time, with or without notice. Certain provisions survive termination, including liability limitations and indemnification.

15. Indemnity and Release

You agree to indemnify and hold harmless askatoz.com, its affiliates, officers, employees, and agents from any claims, damages, or liabilities arising from your use of the Platform or violation of these Terms.

16. SMS Terms

By registering, you consent to receive communications including SMS messages related to your account and transactions. You may opt-out as provided in communications.

17. Disclaimers

The Platform and all content are provided “AS IS” without warranties of any kind. askatoz.com does not guarantee accuracy, reliability, or suitability of content.

You use the Platform at your own risk.

18. Limitation of Liability

To the fullest extent permitted by law, askatoz.com shall not be liable for any indirect, incidental, special, or consequential damages.

Total liability shall not exceed the greater of: (i) $100; or (ii) the amount paid by you to askatoz.com in the past 12 months.

19. Arbitration and Class Action Waiver

Any dispute arising from these Terms shall first be attempted to be resolved informally by contacting info@askatoz.com.

If unresolved, disputes shall be resolved through binding arbitration on an individual basis. You waive any right to participate in a class action lawsuit.

20. Governing Law

These Terms shall be governed by the laws applicable in your operating jurisdiction unless otherwise required by law.

21. Application License

askatoz.com grants a limited license to use its mobile application for personal use only, subject to these Terms.

22. General

These Terms, along with the Privacy Policy, constitute the entire agreement between you and askatoz.com. If any provision is found invalid, the remaining provisions remain enforceable.
